According to a law, once accident happened the insurance only pay for repair from new damages not from old damages. It's insurance fraud if they pay for whole repair that is not part of their causes. When the accident happen, it cause rear bumper to fall off and it needed new bumper, how can insurance pay for new bumper if some of it was already damages when I buy those car? I was in an accident three weeks ago. It was the other car's fault. There were no injuries. We didn't call the police, but I got a written statement from the other driver admitting fault. But they have the signed statement from her admitting fault. The agent in charge of my claim doesn't even pick up the phone or return my calls, I just talk to the operator who can't really give me any answers. I have the basic car insurance, I don't have collision coverage, so I haven't even called my own insurance. My car is operational but my rear susspension is gone, and the bent metal is hitting my tire; I really need my car rapaired asap. Should I call a lawyer even though there were no injuries? Friend driving car got into accident in my car in ohio, insurance question?

I wasn't in the car. I let them go pick up a friend, they were on a semi busy street. My friend was walking up the street and my friend driving the car pulled over with the hazards on to let him in. 10 seconds after getting in the car and closing the door someone slams into the back of my car going between 40-60 mph in a 35mph zone. Totaled other driver's car. My rear end is completely crumpled, but still drivable. I haven't got it checked yet, waiting for the police to contact me in a couple days. Looks like it crumpled all the way to the rear of the frame so it may be bent or busted, so they might say it's totaled. If the other driver was at fault it should be her insurance's responsibility correct? She had full insurance coverage. My friend driving my car has full insurance coverage. I have insurance that only covers bodily injury/property damage liability and medical payments. Who's insurance should cover this?
